I Got This In A Email
To Whom It May Concern:
Please be advised that I represent Christian Motorsports International, Inc., holder and registered owner of a United States Trademark for the name “Racers For Christ®”. Racers For Christ® was founded in 1971, along with an original Federal Government 501 (c) (3) determination under Racers For Christ International, Inc. The organization has been actively in possession and use of the name for 34 years now, and it is our desire to minimize confusion both in the motorsporting world and the Christian community from having two "ministry operations" using the same name. Although we’re sure your use of the name up until now was simply because you didn’t know that the name was already in use and owned by my clients, and expect that your intentions in using the protected name were purely innocent and unintentional, we must respectfully request that you immediately cease and desist from using our client’s registered, legal name and property without license or permission.
Certainly, you wouldn’t use the name “NASCAR®” as your own (or risk the legal exposure), since you know it is owned by another organization. Now that you have been put on formal notice that Racers For Christ® is also a trademarked name, we trust that you will extent to my clients the same respect and dignity in honor of the many years of hard work they put into establishing that name for their organization.
Certainly, we welcome any questions you may have and it is our deepest desire to resolve this matter with a minimum of difficulties, however, we trust you can also understand not only the legal implications, but also the pragmatic issues which require us to make this request of you. Thank you for your anticipated expedient attention and careful consideration of this matter.
Regards,
